Terms of Use

These Terms of Use ("Terms") govern your use of benratnerrealtor.com, the Deal Engine, and the investor portal (together, the "Services"), provided by Ben Ratner, a licensed real estate broker affiliated with Real Broker, LLC ("Ben," "we," "us"). By using the Services or checking the agreement box, you agree to these Terms.

1. What the Services are

The Deal Engine is a free tool that searches publicly available property listings and estimates financial results, such as cash flow, cash-on-cash return, cap rate, cash to close and a suggested maximum offer, using assumptions you provide or that we apply.

2. Estimates only, not advice

All figures are estimates based on listing data, assumed market rents, taxes, insurance, operating costs and the loan terms entered. They are not appraisals, guarantees, or financial, investment, tax, lending or legal advice. Listing information comes from third parties and may be incomplete, outdated or inaccurate, and properties may already be under contract or sold. Before making any decision, you are responsible for verifying all information with your lender, inspector, insurance agent, tax assessor, attorney and other qualified professionals.

3. No agency relationship from using the tool

Using the Services does not create a broker–client, agency or fiduciary relationship. A brokerage relationship begins only when you and the brokerage sign a written agreement, as Illinois law requires. Before touring a property with Ben, you may be asked to sign a written buyer representation agreement.

4. Referrals outside Illinois

If you invest outside the markets where Ben is licensed, we may introduce you to a licensed agent in that area. You choose whether to work with that agent. Ben and Real Broker, LLC may receive a referral fee from that agent's brokerage, paid by the brokerage and not by you, and we'll tell you before any introduction.

5. Your account and information

• Give accurate information and keep it current.
• Keep your login private. You're responsible for activity under your account.
• Use the portal for your own investment decisions. Don't share access, resell or republish its content, or copy data using automated tools.
• We may change, suspend or end the Services or your access at any time, for any reason.

6. Communications

If you check the communications box, you agree that Ben may contact you by email, phone and text, including by automated means, about the Services and investment properties. You can opt out at any time by replying STOP to texts, using the unsubscribe link in emails, or contacting us. Opting out of marketing won't close your portal.

7. Fair housing

We follow all federal, state and local fair housing laws and do not discriminate on any protected basis. Equal Housing Opportunity.

8. Disclaimer of warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, and uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, Ben Ratner and Real Broker, LLC are not liable for any indirect, incidental, consequential or lost-profit damages, or for any investment decision, purchase, financing or loss arising from your use of or reliance on the Services. Our total liability for any claim relating to the Services will not exceed $100.

10. Indemnification

You agree to indemnify and hold harmless Ben Ratner and Real Broker, LLC from claims arising out of your misuse of the Services or your violation of these Terms.

11. Changes

We may update these Terms. We'll post the new version here with a new effective date, and may ask you to accept material changes before continuing to use the portal.

12. Governing law

These Terms are governed by the laws of the State of Illinois. Any dispute will be resolved in the state or federal courts located in DuPage County, Illinois.
